TERMS OF SERVICE

These Terms of Service (“Terms”) govern your access to and use of the Pilanies mobile application, website (www.pilanies.com), content, products, and related services (collectively, the “Services”) provided by Pilanies LLC (“Pilanies,” “we,” “us,” or “our”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, discontinue use immediately or contact support@pilanies.com

 

1. Eligibility

You must be at least 18 years of age and legally capable of entering into a binding agreement to use the Services. By using the Services, you represent and warrant that you meet these requirements.

 

2. Account Registration

To access certain features, you may be required to create an account and provide accurate, current information. You are responsible for:

  • Maintaining the confidentiality of your login credentials

  • All activities that occur under your account

  • Notifying us immediately of unauthorized access or misuse

Pilanies reserves the right to suspend or terminate accounts that violate these Terms.

 

3. Subscription and Payment

Some features of the Services may require payment through a subscription, membership, or one-time fee (“Paid Services”).

  • All purchases are processed through secure third-party platforms (e.g., Stripe, Apple In-App Purchases, Google Play Billing).

  • Prices are subject to change with notice where required by law.

  • Subscription fees are billed on a recurring basis unless cancelled.

  • You are responsible for cancelling prior to renewal to avoid further charges.

We do not issue refunds except where required by applicable law.

 

4. Intellectual Property

All content provided through the Services—including workouts, class videos, text, images, trademarks, designs, branding, logos, and software—is owned or licensed by Pilanies and protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial use only.

You agree not to:

  • Copy, reproduce, modify, or distribute content

  • Create derivative works or reverse engineer any part of the Services

  • Share, resell, or redistribute videos or access credentials

  • Use the Services for commercial or competitive purposes

 

5. Health and Wellness Disclaimer

Pilanies provides fitness and wellness content, not medical advice. You acknowledge and agree that:

  • Pilanies is not a healthcare provider and is not governed by HIPAA

  • Content is for informational and educational purposes only

  • You should consult a physician before starting any exercise regimen

  • Participation is voluntary and at your own risk

If you have any condition that could be impacted by physical activity, you are responsible for obtaining medical clearance before use.

 

6. User Conduct

You agree not to engage in any behavior that:

  • Violates laws or third-party rights

  • Harasses, threatens, or harms others

  • Attempts to hack, disrupt, or damage the Services

  • Infringes intellectual property or privacy rights

Pilanies may suspend or terminate access if you violate these requirements.

 

7. Third-Party Services

The Services may integrate or link to third-party platforms, including payment processors, hosting providers, or analytics tools. We are not responsible for third-party services and you use them at your own risk.

 

8. Cancellation and Termination

You may cancel your subscription at any time through your account settings or the marketplace where you purchased it (e.g., Apple or Google). Cancellation takes effect at the end of the current billing cycle.

Pilanies may terminate access at any time for violations of these Terms or behavior that compromises the integrity of the Services.

 

9. Disclaimers

To the fullest extent permitted by law, the Services are provided “as is” and “as available” without warranties of any kind, express or implied. Pilanies does not guarantee:

  • Error-free operation

  • Continuous availability

  • Specific fitness results or outcomes

  • Accuracy or completeness of content

Use of the Services is at your own risk.

 

10. Limitation of Liability

To the maximum extent permitted by law, Pilanies and its officers, employees, agents, contractors, and partners are not liable for any indirect, incidental, consequential, special, or punitive damages, including injuries, economic loss, or data loss, arising from your use of the Services.

Our total liability to you for any claim is limited to the amount paid in the 12 months preceding the event giving rise to the claim.

 

11. Indemnification

You agree to defend, indemnify, and hold harmless Pilanies from any claims, damages, liabilities, and expenses (including legal fees) arising from your use of the Services or violation of these Terms.

 

12. Governing Law

These Terms are governed by and interpreted in accordance with the laws of the State of [Your State], without regard to conflict-of-laws principles. Any disputes will be resolved exclusively in the courts located in [Your County/State].

 

13. Changes to the Terms
